Charges against Jimmy Michael Giorsetti (Don Bolles)

OK, so I kept on digging after reading the MySpace blurb and finding the Orange County, California Case Summary. The next question - exactly what are the charges against Jimmy Michael Giorsetti (Don Bolles)?

Giorsetti is charged with one violation of the California Health and Safety Code, and two violations of the California Penal Code. Specifically:

CALIFORNIA HEALTH AND SAFETY CODE, 11377(a)

11377. (a) Except as authorized by law and as otherwise provided in subdivision (b) or Section 11375, or in Article 7 (commencing with Section 4211) of Chapter 9 of Division 2 of the Business and Professions Code, every person who possesses any controlled substance which is (1) classified in Schedule III, IV, or V, and which is not a narcotic drug, (2) specified in subdivision (d) of Section 11054, except paragraphs (13), (14), (15), and (20) of subdivision (d), (3) specified in paragraph (11) of subdivision (c) of Section 11056, (4) specified in paragraph (2) or (3) of subdivision (f) of Section 11054, or (5) specified in subdivision (d), (e), or (f) of Section 11055, unless upon the prescription of a physician, dentist, podiatrist, or veterinarian, licensed to practice in this state, shall be punished by imprisonment in a county jail for a period of not more than one year or in the state prison.

CALIFORNIA PENAL CODE, 166(a)(4)

166. (a) Except as provided in subdivisions (b), (c), and (d),
every person guilty of any contempt of court, of any of the following
kinds, is guilty of a misdemeanor:...(4) Willful disobedience of the terms as written of any process or court order or out-of-state court order, lawfully issued by any court, including orders pending trial.

CALIFORNIA PENAL CODE, 166(c)(1)

(c) (1) Notwithstanding paragraph (4) of subdivision (a), any willful and knowing violation of any protective order or stay away court order issued pursuant to Section 136.2, in a pending criminal proceeding involving domestic violence, as defined in Section 13700, or issued as a condition of probation after a conviction in a criminal proceeding involving domestic violence, as defined in Section 13700, or that is an order described in paragraph (3), shall constitute contempt of court, a misdemeanor, punishable by imprisonment in a county jail for not more than one year, by a fine of not more than one thousand dollars ($1,000), or by both that imprisonment and fine.

Hmm. The original MySpace plea didn't mention domestic violence (unless you consider the broken tail light to be a domestic violence incident). Then again, perhaps The Man could be trumping up charges, or adding charges, or engaging in "clerical errors."

Again, the full story obviously isn't out yet.
